Ved børsnoterede aktier forstås for det første aktier, der er noteret på en fondsbørs i et land inden for EU/EØS. Ved børsnoterede aktier forstås endvidere aktier, der er noteret eller omsættes på en børs, der er medlem af World Federation of Exchanges. Aktier, der er OTC-noterede (Over The Counter), anses ikke for at være børsnoterede.
Omsættelige investeringsforeningsbeviser anses for børsnoterede. Det vil sige, at også investeringsforeningsbeviser, der hverken er noteret på en fondsbørs eller på en anden børs, der er medlem af World Federation of Exchanges er omfattet af de regler, der gælder for børsnoterede aktier, herunder reglen om begrænsning af fradrag for tab i § 14.
Aktier, der ikke er omfattede af definitionen af børsnoterede aktier, anses for unoterede. Aktier, der er suspenderet fra noteringen på en fondsbørs m.v., anses for unoterede.
